The Sovereign People of Luytena, in the spirit of their success, their contribution to peace and the preservation of their traditions, hereby approve this Constitution:
Article 1.
The name of the micro-state shall be Republic of Luytena and the form of government thereof shall be a Representative Government. All power shall be inherent in, and derive from, the citizens of the micro-state and may not be exercised without their consent.
Article 2.
The micronational flag shall have three horizontal bands of red, white and orange, and above them a chalice.
Article 3.
The official language is English. Minorities and the right to use their languages will be recognized.
Article 4.
The Coat of Arms of Luytena shall be a chalice on a red background, with the name of the Republic above it on a white background.
Article 5.
All citizens have the right to life, personal dignity, work, assembly and association for lawful purposes.
Article 6.
No one shall be deprived of constitutional rights, physical or mental torture shall be abolished, and any discrimination on the basis of gender, race, social status, religious belief or political ideology shall be prohibited.
Article 7.
The right to private property is recognized; no one may be deprived of it without due compensation.
Article 8.
1. The National Congress will be the only legislative chamber of the nation, composed of 100 seats to be distributed, according to the d`Hondt method, among up to 5 congressmen who obtain a minimum threshold of 25% of votes. 2. The National Congress will be elected every year. 3. The National Congress may dismiss the Presidency of the Republic by absolute majority. 4. The National Congress will be elected in democratic elections by all citizens over the age of 18 who have not been disenfranchised.
Article 9.
1. The Government shall consist of the Presidency, elected every two years in democratic elections by all citizens over the age of 18 who have not been disenfranchised. 2. The Presidency may appoint secretariats to manage the departments of government.
Article 10.
1. The judiciary shall be managed by independent judges, elected by the National Congress every six months. 2. The Court of First Instance and the Supreme Court are established. 3. The Supreme Court shall rule on all constitutional matters. 4. All accused persons have the right to a trial with the presumption of innocence with impartiality and to free defense. 5. People’s juries elected by lot, with the advice of a judge, shall decide on any non-constitutional matter.
Article 11.
1. Luytena is structured in territories through states. 2. The states will have a Governorate and a Congress, structured in the same way as established by the Constitution. The National Congress may create or dissolve states. 4. The National Congress may intervene cantons to ensure national security in Luytena.
Article 12.
The Constitution will be the supreme law. All laws enacted and policies established by citizens shall be in accordance with the Constitution. No one can be above the Constitution.
Article 13.
The Constitution may be amended when authorized by a referendum with a minimum participation of 50% of the citizens with the right to vote and a support of more than 50%.
